On May 5 and 7, the Taxpayers Protection Alliance (TPA) submitted public comments in response to the Department of Commerce’s request for public comments regarding the use of tariff power under Section 232 of the Trade Expansion Act of 1962. In these comments, TPA reminded the Department that levying tariffs under Section 232 for any reasons beyond threats to national security is a violation of the law.
TPA’s two submissions focused on the use of Section 232 authority to levy tariffs against imports of pharmaceutical products and ingredients, and against imports of semiconductors and semiconductor manufacturing equipment. In both comments, TPA highlighted that by levying tariffs against potentially life-saving products or in key inputs in the technological race, the administration is undermining the national security interests of the United States.
