Consumer Watchdog Strongly Opposes Section 230 Repeal Proposal

WASHINGTON, D.C. – Reps. Frank Pallone (D-N.J.) and Cathy McMorris-Rodgers (R-Wash.) recently introduced legislation to sunset 47 U.S. Code § 230, better known as Section 230. Section 230 is a vital part of American law that is essential to the functional, innovative internet ecosystem we know today.

In response, TPA Executive Director, Patrick Hedger offered the following comment:

“The continued efforts to repeal Section 230 may be well-intended, however, they are also incredibly misguided. There is very little doubt that protecting speech online is a noble goal, as is trying to right the wrongs that many face on the internet in an increasingly digital world. However, it is with these precise goals in mind that Section 230 was passed into law. Repealing it would actually reverse progress on these intended outcomes.

“As Section 230’s authors describe it, this provision provides internet platforms with both a shield, to protect free expression online, and a sword, to combat harmful practices, without fear of legal retribution. With Section 230, platforms are empowered to combat practices like online sex trafficking and illicit trade. They are also able to leave discussion open to constitutionally-protected speech, knowing they will not be held liable for what is said on their sites – only the actual speakers or authors will be.

“Repealing Section 230 would take away this sword and this shield. Platforms would become more vigilant in censoring speech, as they would have to cover their bases, lest they become legally responsible for anything said on them. They would also lose the ability to moderate their platform as they see fit. Upending the internet ecosystem away from the very careful balance Section 230 has struck would be disastrous, despite the honorable intentions of the bill sponsors.”
